Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Nexara platform, website, and services (collectively, the “Service”) operated by Nexara (“Nexara”, “we”, “us”). By creating an account or using the Service you agree to these Terms.
1. The Service
Nexara provides an AI-powered receptionist and business communication platform: answering phone calls, responding to website chat, WhatsApp and SMS messages, booking appointments, capturing leads, and related business tools. The Service relies on third-party providers (including telephony, AI model, and messaging providers) and the exact behavior of AI-generated responses cannot be guaranteed.
2. Accounts
- You must provide accurate information and keep your credentials secure.
- You are responsible for all activity under your account, including team members you invite.
- You must be at least 18 years old and authorized to act for the business you register.
3. Subscriptions and billing
- The Service is billed monthly in advance through our payment provider, Lemon Squeezy.
- Each plan includes a monthly allowance of AI call-minutes; usage beyond the allowance is billed at the per-minute overage rate shown on the pricing page.
- You can cancel at any time; access continues until the end of the paid period. Refunds are governed by our Refund Policy, including a 7-day money-back guarantee on your first payment.
- We may change prices with at least 30 days’ notice; changes apply from your next billing cycle.
- If payment fails, we may suspend access until payment is resolved.
4. Call recording and compliance — your responsibilities
The Service can record and transcribe phone calls and store message conversations. You are responsible for complying with the call-recording, consent, and privacy laws that apply in your jurisdiction and your callers’ jurisdictions (for example, two-party consent rules or requirements to announce recording). You must also comply with messaging regulations (such as TCPA and carrier rules) when using SMS and WhatsApp features, and only message people who have consented to be contacted.
5. Acceptable use
- No unlawful, deceptive, or fraudulent use, including impersonation or robocall spam.
- No attempts to breach, probe, or overload the Service or its infrastructure.
- No use of the Service to send unsolicited bulk communications.
- We may suspend accounts that create abnormal cost, legal, or abuse risk while we investigate.
6. AI disclaimer
AI-generated responses can be inaccurate or incomplete. The Service is a communication assistant, not professional advice, and you should not rely on it for medical, legal, financial, or emergency purposes. You are responsible for reviewing how your AI receptionist is configured and what it tells your customers.
7. Your data
You retain ownership of your business data (contacts, transcripts, recordings, documents). You grant us the rights needed to operate the Service — storing, processing, and passing data to the subprocessors that power it. Details are in our Privacy Policy.
8. Termination
You may stop using the Service and cancel at any time. We may terminate or suspend access for breach of these Terms. After account closure we delete or anonymize your data within a reasonable period, except where retention is legally required.
9. Disclaimers and limitation of liability
The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Nexara’s total liability arising out of the Service is limited to the amounts you paid us in the twelve months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunities (such as missed calls or failed bookings).
10. Changes
We may update these Terms. If a change is material we will notify you by email or in-app at least 14 days before it takes effect. Continued use after the effective date constitutes acceptance.
